In this context, you may also need to find a safe place to store it.   <\/li>\n\n\n\n<li>If you are an heir, make sure that you obtain the certificate of inheritance so that you can use it if necessary.<\/li>\n<\/ul>\n<\/div>\n<\/div>\n\n<h2 class=\"wp-block-heading\"><b>Procedure for opening a will<\/b><\/h2>\n\n<p><span style=\"font-weight: 400;\">If a <\/span>testator dies<span style=\"font-weight: 400;\"> and <\/span><span style=\"font-weight: 400;\"> leaves<\/span><span style=\"font-weight: 400;\"> a <\/span><a href=\"https:\/\/www.deinadieu.ch\/en\/advisor\/the-holographic-will\/\" target=\"_blank\" rel=\"noopener\">handwritten<\/a><span style=\"font-weight: 400;\"> will, <strong>you are obliged to submit the will to the competent cantonal authority<\/strong> if you know that the will exists and where it is located.<\/span><\/p>\n\n<p><span style=\"font-weight: 400;\">This obligation applies not only to heirs or legatees, but also, under certain circumstances, to otherwise uninvolved third parties who are aware of the testamentary disposition. If you suppress the will, this may result in a penalty. In addition to criminal sanctions, this behavior can also have other consequences (e.g. <g id=\"gid_0\">ineligibility to inherit<\/g>, liability for damages).  <\/span><\/p>\n\n<p><strong><span style=\"font-weight: 400;\">A<\/span> <a href=\"https:\/\/www.deinadieu.ch\/en\/advisor\/the-notarised-will\/\">publicly notarized will<\/a> is kept<span style=\"font-weight: 400;\"> by a public <\/span>notary (notary or similar)<span style=\"font-weight: 400;\"> from the outset <\/span><\/strong><span style=\"font-weight: 400;\">so that its submission and correct opening of the will is guaranteed with significantly greater certainty.<\/span><\/p>\n\n<p>Within one month of receipt <span style=\"font-weight: 400;\">of the testamentary disposition <\/span>, the competent authority will inform <span style=\"font-weight: 400;\">the heirs and, if applicable, legatees of its content and thus <\/span>of the testator&#8217;s last wishes <span style=\"font-weight: 400;\">in the presence of the heirs <\/span><span style=\"font-weight: 400;\">. If the entitlement of an heir to inherit (e.g. on the basis of another will document) is disputed by co-heirs   <\/span>If the<span style=\"font-weight: 400;\"> inheritance<\/span> is disputed<span style=\"font-weight: 400;\">, it is temporarily not handed over and, if necessary, an <a href=\"https:\/\/www.deinadieu.ch\/ratgeber\/willensvollstrecker-und-erbschaftsverwalter\/\" target=\"_blank\" rel=\"noopener\">estate administrator<\/a> is appointed.<\/span><\/p>\n\n<p><span style=\"font-weight: 400;\">Otherwise, the heirs can <\/span>request <span style=\"font-weight: 400;\">that the authority that approved the opening of <\/span><span style=\"font-weight: 400;\"> the<\/span><span style=\"font-weight: 400;\">will issue a <\/span>certificate of inheritance<a href=\"https:\/\/www.deinadieu.ch\/ratgeber\/die-erbberechtigung-und-der-erbschein\/\" target=\"_blank\" rel=\"noopener\">(certificate of inheritance<\/a>).<\/p>\n\n<h2 class=\"wp-block-heading\"><b>Why do I need a certificate of inheritance and what does it say?<\/b><\/h2>\n\n<p><strong>The certificate of inheritance is a proof of legitimacy and official confirmation that the recipient is entitled to the estate as an heir according to the opening examination<\/strong>. <a href=\"https:\/\/www.deinadieu.ch\/die-erbfolge-nach-dem-gesetz\/\">Legal heirs<\/a> (spouses and descendants) receive a certificate of inheritance even without a will, which establishes their right to dispose of the <a href=\"https:\/\/www.ch.ch\/de\/erbschaft\/\">estate<\/a>.<\/p>\n\n<p><span style=\"font-weight: 400;\">It will be delivered at the earliest after the expiry of the <a href=\"https:\/\/www.deinadieu.ch\/ratgeber\/erbe-ausschlagen-oder-annehmen\/\" target=\"_blank\" rel=\"noopener\">deadline for the waiver<\/a>, provided that the heirs accept the inheritance. Until then, the   <\/span>Assets of the testator blocked<span style=\"font-weight: 400;\">as the heirs cannot dispose of it without the certificate of inheritance, not even to pay the deceased&#8217;s funeral costs or outstanding bills, for example. One way to keep money available in bank accounts in the event of death is to set up an account in the name of the deceased and their spouse or a close relative.  <\/span><\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Invalidity of a will<\/strong><\/h2>\n\n<p>However, even a certificate of inheritance does not mean final entitlement to the inheritance, as heirs or other persons can file an action with the court. In other words, the heirs are still free to sue each other, in particular for the <g id=\"gid_0\">invalidity<\/g> or <g id=\"gid_1\">reduction of<\/g> the will. In such proceedings, issued certificates of inheritance can improve the procedural position of their owners, as they reverse the burden of proof and, where applicable, the procedural roles.  <\/p>\n\n<p>Once the heirs&#8217; entitlements to the estate have been finally clarified, they can take possession and (sole) ownership of the assets and any tangible assets.<\/p>\n\n        <div class=\"da-servicebox relative bg-gray-200 p-4 pt-8 border-solid border-t-8 border-da-dark mb-6\">\n            <i class=\"fas fa-info-circle mx-auto fa-7x text-da-dark\"><\/i>\n            <span style=\"hyphens: auto\">\n                <br \/>\nIn the event of death, a will must be submitted to the cantonal authority for opening. This authority usually informs the heirs verbally and in writing of its contents. Until the estate is divided, the estate is blocked and the heirs are only authorized to dispose of it jointly. They can request that a certificate of inheritance be issued in their name in order to obtain provisional rights to the estate.
