This offers advantages that can mostly pay off when circumstances are complicated or an estate is valuable.<\/p>\n\n<!--more-->\n\n<h2 class=\"wp-block-heading\" id=\"h-offentliches-beurkundungsverfahren\"><b>Notarisation procedure<\/b><\/h2>\n\n<p>The <a href=\"https:\/\/www.fedlex.admin.ch\/eli\/cc\/24\/233_245_233\/de\" target=\"_blank\" rel=\"noreferrer noopener\">Swiss Civil Code<\/a> provides for three ways to issue a unilateral testamentary disposition. These are: the <a href=\"https:\/\/www.deinadieu.ch\/en\/advisor\/the-holographic-will\/\" target=\"_blank\" rel=\"noopener\">handwritten will<\/a>, the <a href=\"https:\/\/www.deinadieu.ch\/das-nottestament-voraussetzungen-und-zustande-kommen\/\" target=\"_blank\" rel=\"noreferrer noopener\">(oral) emergency will<\/a>, and the notarised will. The procedure is regulated in the ZGB in principle, but takes place in the presence of <a href=\"https:\/\/www.deinadieu.ch\/ratgeber\/wie-funktioniert-das-notariat-in-der-schweiz\/\" target=\"_blank\" rel=\"noopener\">authenticating officials<\/a> under cantonal law. This allows the legislature to guarantee a<b> <\/b>notarisation that is standardised throughout the confederacy and is valid in all of Switzerland.<\/p>\n\n<p>During notarisation, t<span style=\"font-weight: 400;\">he <\/span>authenticating official records<b> <\/b><span style=\"font-weight: 400;\">the final wishes as stated by the testator under the <\/span><strong><span style=\"font-weight: 400;\">cooperation of <\/span>two witnesses<span style=\"font-weight: 400;\"> in an official document<\/span><\/strong><span style=\"font-weight: 400;\">. This must be <strong>dated and signed<\/strong> by both the testator and the authenticating official. The witnesses <\/span>confirm<span style=\"font-weight: 400;\"> by their signatures that the testator has declared in their presence that the deed reflects the testator\u2019s final wishes. Therefore, it is not imperative that they be familiar with the content of the will.<\/span><span style=\"font-weight: 400;\"><\/span><\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-geht-das-offentliche-testament-den-anderen-formen-vor\"><b>Does the notarised will take precedence over the other types?<\/b><\/h2>\n\n<p>The various types of <a href=\"https:\/\/www.deinadieu.ch\/testamentgenerator\/\" target=\"_blank\" rel=\"noreferrer noopener\">wills<\/a> mentioned above have equal status. So none of them can make a generalised claim of priority over the others. It is true that notarisation probably has a more specific evidentiary function and guarantees optimal legal certainty when reviewed by expert authenticating officials. However, a notarised will can be blocked by another testamentary disposition that contradicts it. This means the more recent testament will take precedence.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-vorteile-des-offentlichen-testaments\"><b>Advantages of the notarised will<\/b><\/h2>\n\n<p>Since <a href=\"https:\/\/www.deinadieu.ch\/en\/advisor\/notarial-certification-when-to-consult-a-notary\/\" target=\"_blank\" rel=\"noreferrer noopener\">notarisation<\/a> incurs <strong>fees<\/strong> and the expense of an appointment with a notary or another official channel, it is chosen less frequently than the <a href=\"https:\/\/www.deinadieu.ch\/en\/advisor\/the-holographic-will\/\" target=\"_blank\" rel=\"noreferrer noopener\">handwritten testament<\/a>. But when it comes to expressing the testator\u2019s final wishes, it can be worth it to invest in a deed that, due to the qualified procedure it entails, offers particular legal certainty: first, the people entrusted with the notarisation have a thorough knowledge of the applicable law. This means they can recognise and avoid <strong>deficiencies in a testamentary disposition<\/strong>. This simplifies the inheritance process and prevents the testator\u2019s final wishes from being invalidated by an <a href=\"https:\/\/www.deinadieu.ch\/ratgeber\/testament-anfechten\/\" target=\"_blank\" rel=\"noreferrer noopener\">action for annulment<\/a>.<\/p>\n\n<p>Second, the authenticating officials are obligated to keep the <strong>dispositions (either in the original or a copy<\/strong>)<span style=\"font-weight: 400;\"> or to hand them over to a competent government authority for that purpose. In this way, the legislature wishes to ensure that the notarised will can be properly opened for the heirs <\/span>when the testator dies<span style=\"font-weight: 400;\">. If the testator stores a handwritten will in an unknown or sealed location, or if the will is misappropriated, the will might not be opened, meaning the testator\u2019s wishes might not be realised. And this might lead to a different succession. Like the handwritten will, the emergency will guarantees little security compared with the official document.<\/span><\/p>\n\n<p><span style=\"font-weight: 400;\">So notarising your final wishes can be worth it, <strong>especially if the inheritance or asset situation is complex<\/strong>. It also avoids certain potential problems.
