This can be a sensitive matter as the will is only effective after the death of the testator. Formal requirements are therefore imposed by law to protect all parties involved.<\/p>\n\n<!--more-->\n\n<h2 class=\"wp-block-heading\" id=\"h-wieso-sollte-man-ein-testament-offentlich-beurkunden-lassen\"><strong>Why should a will be certified by a notary?<\/strong><\/h2>\n\n<p>First of all, a will can be drawn up in one of three forms:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.deinadieu.ch\/ratgeber\/das-handschriftliche-testament-2\/\" target=\"_blank\" rel=\"noreferrer noopener\">holographic will<\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/www.deinadieu.ch\/en\/advisor\/the-notarised-will\/\" target=\"_blank\" rel=\"noreferrer noopener\">will by public deed (notarial certification)<\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/www.deinadieu.ch\/das-nottestament-voraussetzungen-und-zustande-kommen\/\" target=\"_blank\" rel=\"noreferrer noopener\">oral will (emergency will)<\/a><\/li>\n<\/ul>\n\n<p><\/p>\n\n<p>The will by public deed is drawn up with the assistance of a notary and two witnesses. Furthermore, the confirmation of the testator\u2019s capacity of judgement in the deed makes it more advantageous compared to a holographic will. If there are doubts about the testator\u2019s capacity of judgement, the witnesses can confirm the testamentary capacity with their signature. <strong>This avoids any <a href=\"https:\/\/www.deinadieu.ch\/ratgeber\/die-anfechtung-des-testaments\/\" target=\"_blank\" rel=\"noreferrer noopener\">invalidity claims<\/a> in the future.<\/strong><\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-wie-lauft-das-beurkundungsverfahren-ab\">What happens during the certification process?<\/h2>\n\n<p>The notary first begins with the <strong>preliminary proceedings<\/strong>, during which the notary explains to the testator what will happen in the proceedings and prepares the main proceedings. In the <strong>main proceedings<\/strong>, the notary draws up the contents of the will. Then the testator reads and signs the will, thereby giving his or her consent. The next step is for the notary to date and sign the will. <\/p>\n\n<p>Now the testator must declare in the presence of the two witnesses and the notary that he or she has read the document and that it contains his or her will. In the next step, the witnesses must sign the deed and in so doing confirm that the testator made said declaration in their presence and that he or she was in full possession of testamentary capacity. Now the certification process of a will is complete.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-das-vorlesungsverfahren-wenn-das-selbstleseverfahren-unmoglich-ist\">Reading out the will by the notary when the testator cannot<\/h2>\n\n<p>If the testator cannot read the will himself or herself for any reason (e.g. physical impairment) as explained above, the notary can read out the will in the presence of the two witnesses. Afterwards, the testator declares that the deed contains his or her will. If the notary reads out the will, the witnesses acknowledge the contents of the will. However, it must meet several formal requirements, otherwise it is <a href=\"https:\/\/www.deinadieu.ch\/ungueltigkeitsklage-eines-testaments\/\" target=\"_blank\" rel=\"noreferrer noopener\">invalid<\/a>.<\/p>\n\n<ul class=\"wp-block-list\">\n<li>The will must be <strong>written in the testator\u2019s own hand<\/strong> from start to finish,<\/li>\n\n\n\n<li>and must be <strong>dated and signed<\/strong> by the testator. If even a part is written by someone else or typed on a computer, that part is invalid.<\/li>\n\n\n\n<li>Each person must draw up <strong>their own will<\/strong>. If, for example, a wife would like to draw up a will, she can only do so for herself. She cannot draw up the will together with her husband. If she would like to include her husband or other persons as contractual parties in her will, she could enter into a contract of succession.<\/li>\n<\/ul>\n\n<p><\/p>\n\n<p>Finally, there is the <a href=\"https:\/\/www.deinadieu.ch\/ratgeber\/das-muendliche-testament\/\" target=\"_blank\" rel=\"noreferrer noopener\">oral will<\/a>. However, this form is only used for <a href=\"https:\/\/www.deinadieu.ch\/das-nottestament-voraussetzungen-und-zustande-kommen\/\" target=\"_blank\" rel=\"noreferrer noopener\">emergency situations<\/a> and is valid for a limited period of time.<\/p>\n\n<h2 class=\"wp-block-heading\"><b>What else is there to consider?<\/b><\/h2>\n\n<p><span style=\"font-weight: 400;\">The will should be deposited with the competent authority. In the <a href=\"https:\/\/www.gerichte-zh.ch\/themen\/erbschaft\/nachlassplanung\/testament-und-erbvertrag\/aufbewahrung-testamenteerbvertraege.html\" target=\"_blank\" rel=\"noopener\">canton of Zurich<\/a>, this would be the notary offices. These authorities keep inheritance contracts and wills safe. <a href=\"https:\/\/www.deinadieu.ch\/ratgeber\/wie-kann-ich-mein-testament-hinterlegen\/\">Depositing the will<\/a> ensures that the testamentary disposition can be opened in the event of death and that the heirs are informed. It also prevents them from being lost or damaged. An alternative to this is storing the will with a person the testator trusts.<\/span><\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-haben-sie-sich-daruber-schon-gedanken-gemacht\">Have you already given it some thought?<\/h2>\n\n<ul class=\"wp-block-list\">\n<li>Which form of will (holographic will or will by public deed) would you prefer?<\/li>\n\n\n\n<li>Bear in mind that you must comply with the formal requirements of the kind of will you choose.
